Terms of purchase and use

These Terms of purchase and use (the “Terms”) govern the use of the website eshop-kamagra.com (the “Shop”) and the rights and obligations when buying products through the Shop. By using the Shop and placing an order you confirm that you have read, understood and accepted these Terms.

1. Products and information

The Shop offers products for potency and intimate health. The descriptions and content on the Shop’s pages are informational and do not replace the advice of a doctor or pharmacist. Before using any product, consult a professional, especially if you are taking other medicines or have health problems. We strive to keep all information accurate and up to date, but we do not guarantee against typographical errors or subsequent changes.

2. Prices

All prices are stated in euros (EUR) and include the applicable VAT. The price displayed at the time the order is placed applies. The trader reserves the right to change prices and the range without prior notice, whereby a change does not affect orders already confirmed.

3. Ordering and conclusion of the contract

You place an order by adding products to the cart and confirming at checkout. The contract is concluded at the moment the trader receives the order and sends a confirmation to your e-mail address or confirms the order by phone. The buyer is obliged to enter accurate and complete delivery details.

4. Payment

Payment is made by cash on delivery — in cash when collecting the shipment. We do not require advance payment, which reduces the risk to the buyer.

5. Delivery

Delivery is carried out within the Republic of Croatia via delivery services (OVERSEAS courier to your address, parcel lockers / Box Now and the post office). The approximate delivery time is 2–4 business days. All shipments are packed discreetly and neutrally, with no indication of the contents on the package. 6. Right to unilateral termination of the contract

In accordance with the Consumer Protection Act, a consumer has the right, without stating reasons, to unilaterally terminate a distance contract within 14 days. The period starts on the day the product is handed over to the consumer or a person designated by them.

To exercise the right of termination, it is sufficient to send an unambiguous statement of termination before the expiry of the period to info@eshop-kamagra.com (you may also use the form for unilateral termination of the contract). We will refund the amount paid within 14 days of receiving the notice of termination, after the product has been returned to us. The direct cost of returning the product is borne by the consumer.

Exception: in accordance with Article 79 of the Consumer Protection Act, the right to unilateral termination is excluded for the supply of sealed products which, for health or hygiene reasons, cannot be returned if they were unsealed (opened) after delivery. Such products may be returned only if they are unopened and in the original, undamaged packaging.

7. Material defects and complaints (written complaint)

The trader is liable for material defects of the product in accordance with the Civil Obligations Act and the Consumer Protection Act. If you receive a damaged, incorrect or faulty product, contact us as soon as possible.

You can submit a written complaint via the e-mail info@eshop-kamagra.com. We will respond to every complaint in writing within 15 days of receipt. Please include the order number and a description of the defect with your complaint.

8. Liability

The content of the Shop is provided “as is”, for informational purposes. The trader is not liable for the consequences of improper use of products or for use contrary to instructions or the advice of a professional.

9. Protection of personal data

We process your personal data in accordance with the applicable regulations (GDPR) and solely for the purpose of order processing and communication. More in the Privacy policy.

10. Dispute resolution and the ODR platform

We will try to resolve all disputes amicably. In the event of a dispute, the competent court in the Republic of Croatia has jurisdiction, applying Croatian law. A consumer may also initiate a dispute through the European Commission’s online dispute resolution (ODR) platform available at: https://ec.europa.eu/consumers/odr.

11. Changes to the terms

The trader reserves the right to amend these Terms. The Terms in force at the time the order is placed apply to each order.

12. Final provisions

The law of the Republic of Croatia applies to these Terms and to all relations between the buyer and the trader. These Terms are valid from the date of publication on this page.
